I have seen some articles about these new police force that we are supposedly getting. I have seen bashing of him and religion in it. I am studying the Constitution in my American Government class was curious so I did some digging. My homework has been centered on the Constitution so this was right up my alley. I am still learning so I might be a bit off. Input is welcome.
First, the Court’s opinion by Justice O’Connor declares that it makes no difference whether federalism constraints derive from limitations inherent in the Tenth Amendment, or instead from the absence of power delegated to Congress under Article I; ”the Tenth Amendment thus directs us to determine . . . whether an incident of state sovereignty is protected by a limitation on an Article I power.” Second, the Court, without reference to Garcia, thoroughly repudiated Garcia’s ”structural” approach requiring states to look primarily to the political processes for protection. In rejecting arguments that New York’s sovereignty could not have been infringed because its representatives had participated in developing the compromise legislation and had consented to its enactment, the Court declared that “ [t]he Constitution does not protect the sovereignty of States for the benefit of the States or State governments, [but instead] for the protection of individuals.” Consequently, ”State officials cannot consent to the enlargement of the powers of Congress beyond those enumerated in the Constitution.” – click here for more
All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.
If I am understanding all this correctly, what I am reading about this Amendment saying that the Constitution protects “We the people…” and our rights. While we have an executive Branch, laws have to go before Congress before they get to the president.
Changing the Constitution is whole different ball of wax. Congress is the institution who can propose changes to the constitution according to Article V.
The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.
According to 14th Amendment Section 1
“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
Now let’s talk about who can do what. Local Law Enforcement lies in State power hands. That is City, County and State Patrol are governed by the States they are in, not Federal. Federal Law Enforcement Officers are U.S. Marshall’s, F.B.I., National Guard, and Military and are governed by Federal Not State. According to the Constitution the Executive Branch does not have authorization to override the States without Congresses approval. This report says many cities are on board with this. Has anybody asked, “We the People…” if we want UN Rule of Law over our own Constitution?
The DOJ release states in part:
The SCN will connect cities, city-level practitioners and the communities they represent through a series of workshops, trainings and sustained city partnerships. Network participants will also contribute to and benefit from an online repository of municipal-level good practices and web-based training modules and will be eligible for grants supporting innovative, local initiatives and strategies that will contribute to building social cohesion and resilience to violent extremism.
The SCN will include an International Steering Committee of approximately 25 cities and other sub-national entities from different regions that will provide the SCN with its strategic direction. The SCN will also convene an International Advisory Board, which includes representatives from relevant city-focused networks, to help ensure SCN builds upon their work. It will be run by the Institute for Strategic Dialogue (ISD), a leading international “think-and-do” tank with a long-standing track record of working to prevent violent extremism.
I cannot seem to find what UN Laws are. How convenient. I have found this link about the UN Rule of Law. This one talks about the reason the UN steps in is to help “war torn” countries unite. The last I knew we were not a war-torn country…well I suppose we are in a way. The way the media has pitted us against each other; bashing of each other.
We are killing and bullying each other. We must work together to stop this. We must put petty differences aside and remember that we came here to get out from under the thumb of a Monarch that was taxing us ridiculously and discriminating against us for what religion we wanted to practice. We worked together to build a good country, put together the bill of rights, the constitution, organized statehood for this country, and we have just kept going. Let’s not let other countries come in and destroy what our forefathers worked so hard to establish for us to live in.
